Is online gambling legal in New York has two honest answers, and they must stay in separate sentences. Mobile sports betting is legal with licensed operators. New York’s mobile market opened on January 8, 2022. The launch tax on operator gross gaming revenue was widely stated at 51 percent. Confirm the figure in the current statute before you repeat it in an argument, because tax law is amended. The figure is about the book’s bill, not a discount on your bet.

Worked example 1. You are in Brooklyn. A licensed app will take a Knicks spread if you are 21 and inside the state. The same phone shows an ad for online blackjack “coming to New York.” Coming is not live. You can place the spread with a listed book. You cannot treat the blackjack ad as a second licence.

The New York State Gaming Commission licenses the mobile operators and posts the list. Use that list, not a commercial roundup. You need to be physically in New York. Honest apps geofence. Being a New York resident on a trip to another state means you are under the rules of the place you are standing, which may be a different book or no book.

Walking into one of these buildings is legal casino gambling for a patron who meets the age and the facility’s rules. It is not remote gambling. Legislators have introduced online casino bills in multiple sessions, often arguing about cannibalizing the retail floors, the tax rate, and who would be allowed to operate. Those are real policy fights. They are not a description of current law. • If the product is online slots or live-dealer tables, look for an enacted iGaming law and a licensee list. If there is no list, there is no statewide yes.
• For sweepstakes coins, do not use the sportsbook list. Read the sweeps guide and current state sources.
